Terms of Use

The short version

You own your builds and recipes. We provide the platform. Do not use OpenFactory to build malware, attack systems, or violate the law. If you do, we can suspend the account.

These terms govern your use of OpenFactory and related services. By using the platform, you agree to them.

1. Agreement and accounts

  • You must accept these terms to use the service.
  • You are responsible for activity performed under your account and for protecting your credentials.
  • You must be at least 16 years old to use OpenFactory.

2. Acceptable use

Do not use the platform to do harm.

  • Do not build, distribute, or host malware, ransomware, spyware, or other malicious payloads.
  • Do not use OpenFactory to gain unauthorized access to systems, data, or networks.
  • Do not upload illegal content or software that violates export controls or sanctions rules.
  • Do not interfere with the service, abuse shared infrastructure, or bypass platform restrictions.

3. Your content and our platform

  • Your content: You retain ownership of your recipes, builds, configuration, and related output.
  • Our platform: OpenFactory retains ownership of the software, branding, product design, and platform IP.
  • Limited license: You grant us the limited rights needed to host, process, and deliver your requested workloads.

4. Service availability and support

We work to keep the platform reliable, but we do not guarantee uninterrupted availability or error-free operation.

Maintenance windows, upgrades, security events, and third-party outages may affect the service.

Enterprise customers may receive additional support, SLAs, and deployment commitments through a separate agreement.

5. Privacy, compliance, and regulated environments

  • Your use of the service is also governed by the OpenFactory Privacy Policy.
  • If you need HIPAA, GxP, or similar regulated-environment commitments, those must be covered by an enterprise agreement where applicable.
  • You remain responsible for qualification, validation, and lawful operation of the systems you build and deploy.

6. Suspension, termination, and exports

  • You may stop using the service at any time.
  • Before account closure, you should export builds, recipes, and other data you want to keep.
  • We may suspend or terminate accounts that violate these terms, threaten the platform, or create legal or security risk.
  • Where practical, we will explain the reason for suspension and allow an export before final deletion.

7. Liability

To the fullest extent allowed by law, OpenFactory is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability is limited to the amount you paid us for the service in the 12 months before the claim giving rise to liability.

Nothing in these terms limits liability that cannot be limited under applicable law.

8. Governing law and changes

These terms are governed by the laws of the State of Delaware, United States, unless a separate written agreement says otherwise.

If we update these terms materially, we will post the change here and, where appropriate, notify account holders in advance.
