Terms of Use

The short version

OpenFactory helps you build and manage secure operating systems. Your builds belong to you. Your recipes belong to you. We don't claim rights over your work, we don't lock you in, and we make it easy to leave if you want to. Don't use the platform to build malware or do anything illegal, and we'll get along fine.

1. Agreement

By using OpenFactory ("Service"), operated by OpenFactory Inc. ("we," "us," "our"), you agree to these terms. If you don't agree, that's okay — just don't use the Service.

2. Your Account

You can sign up with email/password or Google. You're responsible for keeping your login credentials secure and for everything that happens under your account. Let us know right away if you think someone else has access.

You must be at least 16 years old to use OpenFactory.

3. Don't Be Evil

We built OpenFactory so people can create secure, trustworthy computing environments. Please don't use it to:

  • Build images containing malware, ransomware, spyware, or other malicious software.
  • Create weaponized builds intended for unauthorized access or attacks.
  • Produce images with illegal content or software that violates export controls.
  • Break the law in your jurisdiction.
  • Interfere with the Service or try to access systems you shouldn't.

If we find accounts doing these things, we'll shut them down.

4. Your Stuff Is Yours

You own everything you create — your build recipes, configurations, and ISO images. We don't claim any ownership or intellectual property rights over your work. We only store and process your content to provide the Service to you, nothing more.

The OpenFactory platform itself (our code, design, AI models, and trademarks) belongs to us. Some components are open-source and governed by their respective licenses.

5. Service Availability

We work hard to keep OpenFactory running, but we can't promise 100% uptime. If we need to do maintenance, we'll try to give you a heads up. Enterprise customers can get formal SLA commitments through an enterprise agreement.

6. Privacy & Data

Our Privacy Policy explains exactly what data we collect and why. The short version: as little as possible, never sold, never shared for advertising.

HIPAA: If you need HIPAA compliance for healthcare compute environments, we offer Business Associate Agreements (BAAs). Reach out to privacy@openfactory.tech.

7. GxP & Compliance

OpenFactory provides tools for building validated computing environments. A few things to know:

  • Full GxP-validated builds (21 CFR Part 11, EU Annex 11) require an enterprise agreement.
  • The free and standard tiers include audit trails and verification tooling, but don't constitute a validated environment on their own.
  • You're responsible for your own IQ/OQ/PQ qualification activities. We provide the tools and documentation to support your process.

8. Liability

We do our best to build a reliable, secure platform, but we need to be upfront:

TO THE EXTENT PERMITTED BY LAW, OPENFACTORY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR DOWNTIME — ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IS CAPPED AT WHAT YOU PAID US IN THE PRIOR 12 MONTHS.

This doesn't mean we don't care — it means we can't guarantee that every build will be perfect in every environment. We'll always work to fix issues and make things right.

9. Leaving OpenFactory

You can leave anytime. No tricks, no dark patterns, no "are you sure?" gauntlet.

  • Export first: Before closing your account, you can export all your builds, recipes, and data.
  • Account deletion: Email privacy@openfactory.tech and we'll delete your account and all data within 30 days.
  • ISO cleanup: Build artifacts are purged within 90 days.

On our end, we may suspend accounts that violate these terms. If we do, we'll tell you why and give you a chance to export your data first — unless the violation is severe enough to require immediate action (e.g., malware distribution).

10. Legal Details

These terms are governed by the laws of the State of Delaware, United States. If we ever end up in a dispute (we hope not), it would be resolved in the state or federal courts in Delaware.

You agree to indemnify OpenFactory against claims arising from your misuse of the Service or violation of these terms.

11. Changes

If we change these terms, we'll email you at least 30 days in advance. No surprise changes. If the new terms don't work for you, you can export your data and close your account before they take effect.
